In august 2018, a bus driver took a beating at kulmbach train station. Among other things he got a fist on the eye. Now the incident was heard in the kulmbach district court.
A 31-year-old from plauen got on the bus to kulmbach, but refused to get off at the terminus. After some coaxing, he left the bus after all, only to get back on again shortly afterwards and attack the driver for no apparent reason.
"I felt provoked", the defendant said in the court hearing on thursday and referred to severe depression and traumatic stress disorders he suffers from. He is also undergoing medical treatment for this reason. In addition, he had been under the influence of alcohol at the time of the crime, which had increased his aggressiveness.
In court, he had to answer for intentional bodily harm. In the run-up he had already apologized to the injured party and negotiated a settlement with him.
In a so-called adhasion trial it was decided that the defendant has to pay the injured party 400 euros in installments. The bus driver suffered a hamstring injury to his forearm and a black eye. But also his sunglasses were broken.
Based on his criminal record of eleven entries, judge sieglinde tettmann sentenced the defendant to a fine of 120 daily sentences of ten euros each. The public prosecutor’s office had requested a prison sentence of six months, suspended for probation.
"There are certainly good arguments for a custodial sentence", judge tettmann explained her decision. However, the impacting previous convictions were ten years behind.

"Of course, you can’t just hit someone you don’t know because you don’t feel comfortable, the defendant is a woman, too.", she said. However, it must be taken into account that the accused is ill and was under pressure and under the influence of alcohol at the time of the crime. "I recommend that this potential for aggression under the influence of alcohol be discussed again in a therapy session, so that the accused does not fall into old patterns of behavior."
